Privacy Policy
PLEASE READ THIS PRIVACY POLICY CAREFULLY. This Privacy Policy explains how OrionBets collects, uses, discloses, retains, and protects personal information when you access or use the OrionBets website, applications, subscription offerings, sports analytics, data, content, communications, and related services (collectively, the "Services"). This Privacy Policy is intended to be read together with the OrionBets Terms and Conditions.
IMPORTANT PRODUCT POSITIONING: OrionBets provides sports analytics, data, information, and related subscription content. OrionBets is not a sportsbook, bookmaker, casino, betting exchange, or wagering operator and does not accept, place, execute, arrange, transmit, or facilitate wagers on behalf of users. References in this Privacy Policy to sports, wagering-related analytics, odds, lines, or similar information describe the subject matter of the analytics and do not change the nature of the Services.
1. Scope and Relationship to the Terms
1.1 Scope. This Privacy Policy applies to personal information that we collect through the Services and through related interactions with you, including account registration, subscription purchases, customer support, emails, promotions, surveys, and other communications. It does not apply to information processed solely on behalf of another business under a separate written agreement or to third-party services that maintain their own privacy notices.
1.2 Terms and Conditions. Our Terms and Conditions govern your use of the Services. Capitalized terms not defined in this Privacy Policy have the meanings assigned in the Terms and Conditions. If a provision of this Privacy Policy conflicts with the Terms concerning our handling of personal information, this Privacy Policy controls with respect to that subject matter, except where applicable law requires otherwise.
1.3 U.S.-Focused Notice. This draft is designed primarily for U.S. consumers. If OrionBets intentionally offers the Services to individuals in the European Economic Area, United Kingdom, Switzerland, or another jurisdiction with materially different privacy requirements, Company should adopt the additional jurisdiction-specific disclosures and transfer mechanisms required by applicable law before launch in that jurisdiction.
2. Personal Information We Collect
Depending on how you interact with the Services, we may collect the following categories of personal information:
Identifiers and contact information, such as name, email address, telephone number, username, account identifier, mailing or billing address, and similar identifiers you provide.
Account and authentication information, such as login credentials, account settings, subscription status, and information used to authenticate or secure your account. We do not intentionally request more authentication information than reasonably necessary for the Services.
Commercial and transaction information, such as subscription plan, purchases, renewal history, refunds, promotions, coupon use, and records of products or Services obtained or considered.
Payment-related information. Payment card and other payment credentials may be collected and processed by our third-party payment processor. We may receive limited information about the transaction, such as payment status, card type, expiration information, billing location, or a transaction token, rather than full payment credentials.
Internet, device, and network activity, such as IP address, browser type, device type, operating system, device identifiers, referring URLs, pages or features viewed, clicks, session activity, access times, diagnostic data, crash data, and similar technical information.
Approximate location information, such as city, state, or general geographic area inferred from IP address or similar technical information.
Communications and user-submitted information, such as customer-support requests, survey responses, feedback, reviews, testimonials, contest or promotion entries, and other content you choose to submit.
Preferences and inferences, such as preferences regarding sports, teams, leagues, content, features, subscription offerings, or marketing, and inferences drawn from your interactions with the Services to personalize or improve the experience.
Marketing and attribution information, such as campaign source, referral or affiliate information, ad or campaign identifiers, and information about whether a promotion, email, or referral resulted in a visit, registration, or subscription.
Other information that you voluntarily provide or that we describe to you at the point of collection.
3. Sources of Personal Information
We may collect personal information from the following sources:
Directly from you, including when you create an account, subscribe, communicate with us, complete a survey, participate in a promotion, or otherwise provide information.
Automatically from your browser, device, or use of the Services through cookies, pixels, software development kits, logs, local storage, and similar technologies.
From service providers and processors that support payments, hosting, analytics, customer support, communications, security, fraud prevention, or other business operations.
From affiliates, referral partners, and marketing partners, including attribution information associated with a referral or promotional campaign.
From public or commercially available sources where permitted by law.
From third parties at your direction or with your authorization, including third-party integrations that you choose to connect to the Services.
4. How We Use Personal Information
We may use personal information for the following business and commercial purposes:
Provide, operate, maintain, personalize, and improve the Services and your account.
Process subscription purchases, renewals, cancellations, refunds, and related transactions.
Authenticate users, secure accounts, detect suspicious activity, prevent fraud and abuse, troubleshoot, and protect the integrity of the Services.
Provide customer support and respond to requests, questions, complaints, and other communications.
Send transactional and service communications about accounts, subscriptions, billing, security, changes to the Services, legal terms, and other administrative matters.
Send marketing or promotional communications where permitted by law and consistent with your choices.
Measure traffic, usage, conversions, referral activity, campaign performance, and engagement; conduct analytics; and develop or improve products, features, models, content, and user experience.
Administer referral, affiliate, promotional, survey, or loyalty programs and attribute subscriptions or other qualifying actions to the appropriate source.
Comply with law, regulation, legal process, tax and accounting obligations, and enforceable governmental requests; establish, exercise, or defend legal claims; and enforce our agreements.
Protect the rights, property, safety, and security of Company, our users, our service providers, and others.
Create aggregated, deidentified, or statistical information that does not reasonably identify an individual, and use such information for lawful business purposes.
Carry out another purpose disclosed to you at the time of collection or with your consent.
5. How We Disclose Personal Information
We may disclose personal information to the following categories of recipients, subject to applicable law and contractual restrictions where appropriate:
Service providers and processors that perform services for us, such as cloud hosting, data storage, payment processing, analytics, customer support, communications, security, fraud prevention, and professional services.
Payment processors and financial institutions as necessary to process authorized transactions and address payment disputes, fraud, or chargebacks.
Analytics and attribution providers that help us measure site usage, marketing performance, and affiliate referrals. We do not use these disclosures for cross-context behavioral advertising or targeted advertising.
Affiliates and corporate entities under common ownership or control, where permitted by law and reasonably necessary for the purposes described in this Privacy Policy.
Referral or affiliate partners where necessary to attribute a qualifying transaction, prevent fraud, administer commissions, or address a dispute. We do not disclose full payment credentials to referral or affiliate partners.
Professional advisers, auditors, insurers, banks, and other advisers where reasonably necessary to obtain professional services or protect Company interests.
Government authorities, regulators, courts, law enforcement, litigants, or other parties where we reasonably believe disclosure is required or permitted by law or necessary to protect rights, safety, or security.
A buyer, investor, lender, successor, or other relevant party in connection with an actual or proposed merger, financing, acquisition, reorganization, sale of assets, bankruptcy, or other corporate transaction, subject to appropriate confidentiality protections where practicable.
Other third parties at your direction, with your consent, or as otherwise disclosed when the information is collected.
6. Cookies, Analytics, Advertising, and Tracking Technologies
6.1 Technologies We May Use. We and our service providers may use cookies, pixels, tags, local storage, software development kits, log files, and similar technologies to operate the Services, remember preferences, keep accounts secure, understand usage, measure performance, attribute referrals, and support marketing or advertising activities.
6.2 Essential and Functional Technologies. Some technologies are necessary to provide requested functionality, maintain sessions, remember settings, prevent fraud, and secure the Services. Disabling them may prevent portions of the Services from functioning properly.
6.3 Analytics and Marketing Technologies. We may use analytics and attribution technologies to understand engagement, measure campaigns, and attribute subscriptions. We do not currently use these technologies to support targeted or cross-context behavioral advertising.
6.4 Your Choices. Depending on your jurisdiction and our actual practices, you may be able to manage non-essential cookies through a cookie-preference tool, browser settings, device settings, or an applicable opt-out mechanism. Where required by law, we will honor legally recognized opt-out preference signals, including Global Privacy Control, for the browser or device from which the signal is sent.
6.5 Do Not Track. Some browsers offer a "Do Not Track" setting. Because there is not a uniform industry standard for responding to every Do Not Track signal, our response may vary. This does not affect any obligation to honor an opt-out preference signal that applicable law requires us to recognize.
7. Sale, Sharing, and Targeted Advertising
7.1 No Sale for Money. OrionBets does not sell personal information for monetary consideration in the ordinary meaning of "sell." Certain state privacy laws, however, define "sale," "sharing," or "targeted advertising" more broadly and may treat some disclosures through advertising, analytics, or attribution technologies as covered activity even when no money is exchanged.
7.2 Company-Specific Disclosure Required. OrionBets does not sell or share personal information as defined by the CCPA, and does not process personal information for cross-context behavioral advertising or targeted advertising. Because we do not engage in these activities, a “Do Not Sell or Share My Personal Information” or “Your Privacy Choices” mechanism is not currently required. If our practices change, we will update this Privacy Policy and implement the required opt-out mechanisms before doing so.
7.3 Sensitive Personal Information. OrionBets does not collect sensitive personal information as defined by applicable law. If that changes, we will update this Privacy Policy and provide any required notice and mechanism to limit use of sensitive personal information.
8. Data Retention
We retain personal information for as long as reasonably necessary to provide the Services and fulfill the purposes described in this Privacy Policy, including to maintain accounts and subscriptions, process transactions, provide support, maintain security and fraud-prevention records, comply with tax, accounting, legal, and regulatory obligations, resolve disputes, enforce agreements, protect legal rights, and preserve records necessary for legitimate business operations. Retention periods vary depending on the nature of the information, the context in which it was collected, applicable legal requirements, contractual commitments, limitation periods, and operational needs. We may retain aggregated or deidentified information for longer periods where permitted by law and will not attempt to reidentify data that applicable law requires us to maintain in deidentified form.
9. Data Security
We use administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, acquisition, destruction, loss, misuse, alteration, or disclosure. No method of transmission over the Internet or method of electronic storage is completely secure, and we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your account credentials and should notify us promptly if you believe your account has been compromised.
10. Your Privacy Choices and Rights
10.1 Account Information. You may be able to review or update certain account information through your account settings. You may also contact us using the information in Section 17.
10.2 Marketing Communications. You may opt out of marketing emails by using the unsubscribe link in the message or by following another opt-out method we provide. You may continue to receive non-marketing communications concerning your account, subscriptions, billing, security, or legal notices.
10.3 U.S. State Privacy Rights. Depending on where you reside and whether an applicable state privacy law applies to Company, you may have rights to request access to or confirmation of personal information we process; obtain a copy or portability of certain information; correct inaccuracies; delete certain information; opt out of sale, sharing, targeted advertising, or certain profiling; limit certain uses of sensitive personal information; obtain information about categories of information and recipients; and appeal a decision concerning a privacy request. Applicable rights and exceptions vary by state.
10.4 Exercising Rights. To submit a privacy request, contact us at support@orionbets.co. Where required, we will provide additional methods for submitting requests. Please describe the request and provide enough information for us to reasonably verify your identity and authority. We may deny or limit a request where permitted by law, including where we cannot verify identity or an exception applies.
10.5 Authorized Agents. Where permitted by law, you may designate an authorized agent to submit a request on your behalf. We may require evidence of the agent authority and may ask you to verify your identity or confirm the request directly, unless applicable law provides otherwise.
10.6 Appeals. If applicable law gives you a right to appeal our decision on a privacy request, you may submit an appeal to support@otionbets.co within the 10 day period provided by applicable law. We will respond as required by the law that applies to the request.
10.7 Non-Discrimination. We will not unlawfully discriminate or retaliate against you for exercising a privacy right. We may offer bona fide loyalty, subscription, or promotional programs as permitted by law, subject to any notice or consent requirements that apply.
11. Supplemental Notice for California Residents
11.1 California Notice at Collection. If the California Consumer Privacy Act, as amended ("CCPA"), applies to Company, this Section supplements the remainder of this Privacy Policy for California residents.
11.2 Categories of Sources and Purposes. The categories of sources from which we collect personal information are described in Section 3. Our business and commercial purposes for collecting, using, and disclosing personal information are described in Sections 4 and 5.
11.3 California Rights. Subject to statutory exceptions, California residents may have rights to know/access, delete, correct, opt out of sale or sharing, limit certain uses and disclosures of sensitive personal information, and receive equal service and price notwithstanding the exercise of privacy rights. Requests may be submitted using the methods in Section 10.4.
11.4 Opt-Out Preference Signals. If Company sells or shares personal information within the meaning of the CCPA, Company will process recognized opt-out preference signals, such as Global Privacy Control, in the manner required by applicable law.
11.5 Financial Incentives. OrionBets does not currently offer a financial incentive or price or service difference program tied to the collection, sale, or retention of personal information within the meaning of the CCPA. Promotional discounts (such as limited-time or referral-code offers) are available to eligible users on the same terms and are not conditioned on providing additional personal information or agreeing to the sale or sharing of personal information. If OrionBets introduces such a program in the future, we will update this Privacy Policy and provide the required notice.
11.6 California Shine the Light. California Civil Code section 1798.83 may give certain California residents rights regarding disclosure of personal information to third parties for their direct marketing purposes. To make an applicable request, contact support@orionbets.co.
12. Children and Age Restrictions
The Services are not directed to children under thirteen (13), and we do not knowingly collect personal information from children under thirteen without legally sufficient parental consent. Consistent with the eligibility provisions in the Terms and Conditions, the Services are intended for users who are at least eighteen (18) years old, or the age of legal majority required by the applicable jurisdiction if higher. If you believe a child has provided personal information to us in violation of this Policy, contact us using Section 17 so we can evaluate and, where required, delete the information.
13. Third-Party Services and Links
The Services may contain links to, display information from, or interoperate with third-party websites, platforms, data providers, payment services, analytics providers, social-media services, or other third parties. Their privacy practices are governed by their own notices, not this Privacy Policy. We encourage you to review those notices before providing information to third parties. References to sportsbooks, odds sources, or wagering-related third parties are informational and do not mean OrionBets accepts or facilitates wagers.
14. Deidentified and Aggregated Information
We may create aggregated, statistical, or deidentified information from personal information and use or disclose it for lawful purposes, including analytics, research, product development, security, and business planning. Where applicable law requires us to maintain information in deidentified form, we will take reasonable measures to prevent reidentification and will not attempt to reidentify the information except as permitted by law to evaluate our deidentification processes or for another legally permitted purpose.
15. Business Transfers and Corporate Transactions
Personal information may be disclosed or transferred as part of an actual or proposed merger, acquisition, financing, reorganization, bankruptcy, sale of assets, change of control, or similar corporate transaction. A successor or acquiring party may continue to process personal information subject to this Privacy Policy or another notice provided as required by applicable law.
16. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in the Services, our data practices, legal requirements, or business operations. We will post the updated Privacy Policy and revise the Effective Date above. Where required by law, we will provide additional notice or obtain consent before a material change takes effect. We encourage you to review this Privacy Policy periodically.
